Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

About Mployus and What We Do

Mployus Personnel Services provides guidance and actionable solutions to the Pharmacy Recruitment, General Employment Recruitment, and HR/Employment Law consulting solutions to meet our HR, jobseekers, and Recruitment clients’ needs.

We are able to meet our expectations by providing quality HR Advice to keep our HR client’s businesses in compliance and out of legal troubles and connecting specialized talent with leading employers across several sectors and areas of specializations.

We are a personnel and employment services business as defined in the applicable employment and industry-specific legislation, and regulations, including but not limited to, the Employment Agency Act 1971, common laws, statutory provisions, Case Laws, European Community legislation and a range of fundamental rights enshrined in the Irish Constitution.

All employees who handle personal and business data are fully trained to ensure that the data is processed in line with the General Data Protection Regulations 2018 (GDPR) as well as The Data Protection Act 2018 (DPA 2018).

Our Approach to Privacy

Where you ask us to provide HR Advisory services we may be required to process additional categories of personal data relating to you or other parties to ensure the provision of informed advice.

In order to provide our recruitment services, we need to collect personal data relating to our Candidates.

Generally, you will be required to provide data to us when signing up with us for our services, and you may also be required to do so when registering for events or seminars or when corresponding with us by phone, email, letter or social media. It is important that the personal data we hold about you is accurate and up-to-date. Where your personal data changes during your relationship with us, you should keep us informed of such changes.

Some personal data is automatically collected when you use our website, such as IP address, device identifiers, browser information, and cookie data (see for our cookies policy for further details).

Here in Mployus Personnel Services, the protection of your personal data is very important to us because we recognize how important it is to you. In most cases Mployus Personnel Services is the controller of personal data processed as described in this Privacy Statement for the purposes of the General Data Protection Regulation in Europe (“GDPR”).

This Privacy Statement applies to the processing of personal data by the Mployus Personnel Services in its role as controller of personal data under the GDPR.

Personal Data Collected

This Privacy Statement applies to personal data we process in relation to our:

  • Candidates
  • Recruitment Clients
  • HR Clients
  • Suppliers
  • Website Users

As a personnel services business, we provide HR Advisory services to small businesses (“HR clients”). We also connect those looking for a job (“Candidates”) with businesses who are looking for Candidates (“Recruitment Clients”) or (“Pharmacy clients”). For the purposes of this Privacy Statement, a Candidate is:

  • A job applicant;
  • Someone we recognize as a potential job applicant;
  • A contractor of Mployus Personnel Services.

This Privacy statement is not applicable to employees of Mployus Personnel Services.

Sharing of Personal Data

We handle data obtained in the course of our business services with our HR clients and Recruitment clients and candidates confidentially and securely.

Whilst carrying out our regular task of placing or matching of Candidates with Recruitment Clients particularly, we will need to share your information in order to provide services to you. We will always ensure that any transfer of personal data is undertaken in compliance with the law and ensures that appropriate technical and organizational measures are undertaken by any processor or sub-processors.

In rare situations, personal data of our HR Clients will only be disclosed on a confidential basis to external service providers for the purpose of providing services including technological or administrative assistance. If we share data with an external third party; the operations are governed by a Data Processing Agreement (DPA). We promote high levels of data integrity when working with any external companies.

In certain circumstances, we may disclose personal data to the following:

  • Partners and contractors, if needed, for the performance of services to be provided to our Recruitment Clients, HR Clients, and Candidates. These could include email, chat, ticketing, payment processors, external consultants, auditors, IT consultants, and lawyers;
  • If we are under a duty to disclose or share personal data of our HR Clients, Candidates, and Recruitment Clients in order to comply with any legal obligation (including tax, audit, law enforcement, regulatory bodies, fraud prevention agencies, partners, or advisors), or in order to enforce or apply any contracts that we have; and/or;
  • For the purpose of protecting our rights, property, or safety, or that of our Recruitment Clients, Candidates, HR Clients, or other stakeholders. This may include exchanging information with other companies and organizations for the purposes of fraud protection.

Additionally, we may share Candidate information with the following parties:

  • Clients and potential Clients
  • Third party representatives of our clients;
  • Third parties providing verification services (for example, criminal record checks/pre-employment screening services and assessments);

We may be required to share references provided by Associate Contacts of Candidates in the event of an access request by the Candidate.

Your Data Privacy Rights

You have various Privacy rights in relation to how your personal data is used, and they include the following:

  • The right to be informed about how your personal data is collected and used;
  • The right to ask for access to the copy of information we hold on you;
  • The right to rectify personal data we may hold which is identified as incorrect or misleading;
  • The right to erasure of any personal data; also known as ‘the right to be forgotten’;
  • The right to ask us to restrict what we use your data for;
  • The right to change or update your information you;
  • The right to have your personal data moved to another provider (data portability);
  • The right to object to the processing or certain processing activities;
  • Rights in relation to automated decision-making including profiling.

Where your personal information has been shared by Mployus Personnel Services with others, we will do what we can to make sure those using your personal information on our behalf as processors comply with your request for erasure. Please note that we can’t delete your information where:

  • it is relevant for legal claims;
  • we are required by law to have it;
  • where it is used for statistical or research purposes, where deleting the data would make it impossible to achieve the objectives of the processing.

Please be aware that we cannot give you access to a copy of your data if this would have an adverse effect on the rights of others. We will also not give access to credit/debit card details for any reason.

Data Storage and Security

We will take all steps reasonably necessary to ensure that all personal data is treated securely in accordance with this Privacy Statement and the relevant law. As a company, we promote a ‘paperless’ culture where possible. We do everything we can to prevent security breaches.

We have put in place appropriate technical and organizational procedures to safeguard the information we manage and collect.

Part of our protection strategies to your privacy is to take reasonable steps to verify your identity before granting access to information as appropriate, hence preventing unauthorized access.

We also use secure connections to protect personal data during its transmission. If you have chosen a password, or been granted one, which enables you to access services, you are responsible for keeping this password and other login details very confidential. We ask you not to share your password with anyone. We strongly advise you to inform us immediately if there is suspicion or an obvious loss of data to any unauthorized user. This applies to all stakeholders, including our HR Clients, Recruitment Clients, Candidates, or other website users.

This Privacy Policy explains what MployusPharma (Mployus Personnel Services) does with your personal data if you are a locum, candidate, customer or supplier.

Please read this policy carefully to understand our practices relating to your personal data and how we collect, use, and process this.

Your privacy is important to us, and we are committed to protecting and safeguarding your data privacy rights.

If you do not accept that we process your data in the manner detailed in this Policy, please do not submit any personal data to us.

What personal data we collect and how we use it

MployusPharma (Mployus Personnel Services) collects and uses your personal information to provide the best possible employment opportunities that match your criteria.

Personal data will generally consist of your name, contact details, and other information contained in your CV. We only ask for details that will genuinely help us to help you, such as your name, age, contact details, education details, employment history, immigration status, banking information (if you are to be paid via MployusPharma (Mployus Personnel Services) Garda vetting requirements and PPS, where applicable. Where appropriate we may ask for reference information from previous employment.

MployusPharma (Mployus Personnel Services) will confirm your consent for us to hold your personal information before it is stored and processed. The personal data will be requested, stored, processed, used, and disclosed by MployusPharma (Mployus Personnel Services) for the following reasons:

  • We obtain your information from you when you register on our site, we obtain your information for locum and recruitment purposes.
  • We use your information to send to our clients to put you forward for vacancies when you have given us your permission.
  • We use your information to help us communicate with you about relevant job opportunities and provide career guidance and support, to inform you of locum opportunities and other marketing material that may be of interest to you.
  • Third-parties where we or our client have engaged them to deliver services that have been requested. These may include references, qualifications, criminal reference checking services and/or psychometric evaluation or skill tests. These will be advised to you as part of the process, and you have the option to decline.

For locums who are payrolled via MployusPharma (Mployus Personnel Services), we will also retain information such as bank account details, PPS number, and Garda vetting details. This data will be held for as long as it is legally required to be held by us.

This list is not exhaustive, and we may seek to process, use, or disclose your information for any other purpose which has not been listed above, but always with your explicit consent.

We reserve the right to assign your data to a third party in the event of a sale, merger, liquidation, receivership, or transfer of all the assets of our company in circumstances where the third party agrees to observe the terms of this Privacy Policy. MployusPharma (Mployus Personnel Services) will notify you of such circumstances, and you will be afforded an opportunity to opt-out.

How we collect data

We obtain your personal data by the information which you provide us with when you register on the website and when you update your information.

We obtain information from third parties such as the PSI, references, and via Garda vetting; this instance of obtaining information from third parties is consented to by you before we begin the process.

Who we share data with

We may share your personal data with various parties, in various ways and for various reasons. Primarily we will share your information with prospective employers to increase your chances of securing the job you want. Unless you specify otherwise, we may also share your information with any of our group companies and associated third parties such as our service providers where we feel this will help us to provide you with the best possible service.

How we safeguard data

We care about protecting your information. That’s why we put in place appropriate measures that are designed to prevent unauthorized access to, and misuse of, your personal data.

How long we keep data

We will retain your personal data on our database unless you contact us to remove your information. When you request that your data be removed, we will do so unless we believe in good faith that the law or other regulations require us to preserve it (for example, because of our obligations to tax authorities or in connection with PSI regulations due to locum bookings that have been worked).

How can you access, amend and take back your data

You can access your data at any time by logging into your profile on our system; you are able to amend this data yourself. Should you require any more information on the data we hold, you can contact us directly, and we can discuss and amend data then.

If we are using your data because we deem it necessary for our legitimate interests to do so, and you do not agree, you have the right to object. We will respond to your request within 30 days (although we may be allowed to extend this period in certain cases). Generally, we will only disagree with you if certain limited conditions apply.

Existing data with us

We will endeavor to guarantee that all Personal Data that you have submitted to us is maintained and up to date. However, it is your responsibility to inform us of any changes to your Personal Data to ensure that it is up to date.

Where we currently hold personal information about you, you may at any time request that we modify, update, erase, or provide a copy of this information to you. We may only refuse your request where we are legally obliged to do so. Where your request has been refused, we will provide you with the reasons for this refusal. We will then hold such data for only as long as it is required by law.
