Definitions

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Mployus Personnel Services or Mployus Ireland, Block 14, Station Hill, Clongriffin, Dublin 13.

Personal Data is any information that relates to an identified or identifiable individual.

Website refers to Mployus Personnel Services, accessible from www.mployushr.com

You OR Members mean the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Terms of Use

Here in Mployus, we are committed to providing the most support regarding employment law compliance and HR best practice to our users and HR clients, in a very quick, concise and helpful manner. Due to the complexity of certain aspects of Human Resource Management, we wish to inform you that we do not provide employment advice on the following aspects of HR Management: Employee Relations; Contract for Services (Independent Contractors); General Data Protection Regulation (GDPR); Health and Safety; Conflict Resolution in the workplace; Bullying, Harassment, Grievance, Disciplinary and Capability matters. However, we could provide you with the necessary documents, either as a Handbook or as an addendum, and/or written guides and in some cases, video representations that would be helpful for dealing with such cases.

Subscription

  1. The online subscription is for a minimum period of 3 months. The service is for the use of the named subscriber(s) only. Where the subscriber is not an individual, the employing Organisation is regarded as the contracting party.

Renewal of Service / Cancellation Policy

  1. The service is automatically renewed for a further 3 month term unless written cancellation is received prior to the renewal date. A renewal invoice will be issued in the month preceding renewal and payment terms are 14 days. Mployus Personnel Services reserves the right to suspend the web subscription where payment is overdue; this will not affect the subscriber’s liability to pay the outstanding invoice. Any credit or refund for unused periods of subscription is entirely at Mployus Personnel Services’ discretion.
  2. Members may cancel this agreement within seven (7) working days of the Date of Initial Activation and subject to the terms outlined here. Subject to these terms, members shall receive a full refund of any sums paid.
  3. Cancellation must be made by written notice in accordance with provisions of these Terms and Conditions.
  4. Members who wish to cancel their subscription after the 7 day period has expired should note that no refund shall be made and any sums outstanding shall remain due to payable to Mployus Personnel Services.
  5. Upon Cancellation, Members agree to immediately cease accessing the Online Services and Warrant that no Materials shall be copied, stored or otherwise retained by any Under or other person.

Terms For Mployus Recruitment Clients

Items one to seven are the total Terms and Conditions which govern the recruitment services undertaken by Mployus Personnel Services.

  1. Notification of Successful hire
    The client undertakes to notify Mployus Personnel Services immediately on agreeing an engagement with any applicant who has been introduced by the agency during the preceding 12 months and to pay the agency an introduction fee due in accordance with clause 2 hereof within 30 days of the receipt of invoice.
  2. Invoicing
    Once an offer is made by the client and has been accepted by the job applicant, the recruitment partner will invoice the client on the applicant's agreed start date. The invoice becomes payable within the next 30 days of this start date.
  3. Refund of placement fee
    Provided that our placement fee has been settled in full within the agreed 30 days, should the employment of an applicant, who was introduced by the recruitment partner, terminate within 12 weeks, excluding company redundancies (the recruitment partner cannot accept responsibility or issue a refund for a candidate who is made redundant by the client as these circumstances are beyond our control), the agency will guarantee a replacement. In the event the Client does not wish to replace the placement, the placement fee will be credited or refunded by the recruitment partner in the following manner:
    1. Candidate leaving within 4 weeks – 100% refund;
    2. Candidate leaving within 8 weeks – 50% refund;
    3. Candidate leaving within 12 weeks – 25% refund.
  4. Liability
    Applicants introduced to the client are carefully sourced and selected for the relevant vacancies to be filled. Mployus Personnel Services endeavors to take up references but the client should take all necessary steps to obtain confirmation of the applicant’s necessary skills, qualifications, and general integrity. The ultimate decision to hire an applicant will be the clients. The recruitment partner can accept no liability for any kind of loss or damage to property or for any loss, including without prejudice, to the generality of the foregoing loss of profits, or for any injury to persons arising directly or indirectly from any act or omission of any applicant introduced by the recruitment partner, even if such act or omission is negligent or fraudulent or reveals dishonesty.
  5. Statutory Compliance
    The recruitment partner is committed to compliance with all statutory requirements, specifically the General Data Protection Regulation. We assert our position as Data Controllers in respect of the candidate data collected by us and shared with our clients. Data shared with the client is for the purpose of the recruitment process alone and no authorization is either imputed or inferred regarding the use of the applicant’s personal data beyond that very narrow purpose. In that respect, we recognize that our clients are also Data Controllers and we act as Joint Controllers. Both the recruitment partner and the Client warrant to be compliant with GDPR and will keep the other indemnified against any liabilities in respect of any breach of personal data. Once the applicant is employed by the Client, the recruitment partner ceases to have a joint Controller relationship with the Client in respect of each individual applicant, now an employee of the Client.
  6. Our Service
    Mployus Personnel Services was established in 2023 with the express intention of placing the right candidate with the right employer. Our standard service is a hybrid of database / contingency recruitment and selection. Our highly trained career recruiters will only submit candidates for interview who have expressed a sincere interest in joining your company. We will meet you to ensure our message to the marketplace about you as an organization compliments your overall strategic objectives. We view ourselves as an extension of your HR and Management team and will endeavor to represent you to all candidates as an employer of choice.
  7. Acceptance
    We deem our terms and conditions to be accepted indefinitely should you engage our services by inviting a Mployus Personnel Services’ candidate for interview. Any re-negotiations on terms and conditions can only be entertained with 14 days’ notice in writing by the client and will not include any work previously carried out and will only apply to future work carried out after the request has been made. Application policy

After applying for a job on our Mployus recruitment platform, your application will be stored in the securely on our website where only the employer specified will have access. It will never be shared with another employer or recruiter. All applications are removed and deleted from our secure website 24 months after the job you applied for has expired. By submitting your CV you agree to these Terms of Service

Communication with account holders

Sending jobs by email

Once you sign up with Mployus, we will send you relevant jobs via email. This will either be through job notifications, which must be set up in your jobseekers dashboard where you select specific search criteria. Job notifications can be turned off at any time through your account.

The other way is through the profile you have created on Mployus website we will send you jobs that we think you will be interested in based on your previous search history along with your location. All of our emails will include the option to opt out at any time if you wish to stop receiving job notifications via email.

Other emails & services

Once you are registered with Mployus, we will occasionally email you details about similar products and services that may assist you in your job search. Examples could include CV assistance resources or upcoming job events. Once again you will have the option to opt out of these emails at any time.

Terms and Conditions of MployusPharma

Please read this document carefully before accessing or using the service. By accessing or using the service of MployusPharma, a division of Mployus Personnel Services, you agree to be bound by the terms and conditions below. MployusPharma (Mployus Personnel Services) may modify these Terms and Conditions at any time, and such alterations shall be effective instantly upon publishing and communicating (via e-mail) the modified version.

Definitions

  • Client means the person, firm, or corporate body together with any subsidiary or associated company to whom the Locum/candidate is supplied or introduced.
  • Introduction means the Client’s interview of a candidate, after MployusPharma (Mployus Personnel Services) has passed on to the Client a curriculum vitae or any relevant information which identifies the candidate, and which leads to a permanent position of that candidate).
  • Locum means the individual who is introduced by MployusPharma (Mployus Personnel Services) to render services to the Client).
  • The Assignment means the period during which the Locum is engaged to render services to the Client.

MployusPharma Permanent Recruitment (Irish Pharmacy)

  1. MployusPharma (Mployus Personnel Services) service is free of charge for the candidate.
  2. An introduction fee will be paid by the Client to MployusPharma (Mployus Personnel Services) calculated as follows: Flat rate of 3500 Euro for a Pharmacist, 2000 Euro for a store manager, Technician, or OTC placement, placements for non-store based staff will be calculated as 10% of the candidate’s annual salary. This amount is to be paid by the Client within the first 10 days of the candidate beginning his/her employment.
  3. If the Permanent employee resigns or proves unsuitable, MployusPharma (Mployus Personnel Services) will;
    • Either provide a replacement candidate or refund the Client in the following way:
    • Up to 4 Weeks – 100% refund
    • Up to 6 Weeks – 75% refund
    • Up to 8 Weeks – 50% refund
    • Up to 12 Weeks – 25% refund
    • After 12 Weeks – 0% refund

MployusPharma Locum Recruitment (Irish Pharmacy)

  1. The MployusPharma (Mployus Personnel Services) service is free of charge for the Locum.
  2. MployusPharma (Mployus Personnel Services) acts as an agent on behalf of the Client by providing an introductory service and in entering into specific contractual arrangements with the Locum on the client's behalf.
  3. For the avoidance of doubt, these Terms and Conditions shall not give rise to a contract of employment between MployusPharma (Mployus Personnel Services) and the Locum. MployusPharma (Mployus Personnel Services) acts at all times as an agent for the Locum but makes no charge for that service and assumes no responsibilities as an employer.
  4. When making a booking of a Locum to the Client, MployusPharma (Mployus Personnel Services) Limited shall inform the Client of the identity of the Locum; that the Locum has the necessary or required experience, training, qualifications, and any authorization required by law or a professional body to work the Assignment.
  5. The Locum is deemed to be under the supervision, direction, and control of the Client from the time he/she reports to take up his/her duties and for the duration of the Assignment. The Client agrees to be responsible for all acts, errors, or omissions of the Locum, whether willful, negligent, or otherwise, as though the Locum was on the payroll of the Client.
  6. Deductions will be made in respect of PAYE, PRSI, and Levies in accordance with the PAYE code and any other deductions which MployusPharma (Mployus Personnel Services) is required by law to make in respect of Temporary, Contract, Part-Time employees.
  7. All locum pharmacists will be paid on the 15th day of each month following the month in which the work is carried out. The amount due will be paid directly into his or her bank account or, in some cases, by cheque. A payslip showing the computation of your pay for a relevant period will be provided and sent out by post.
  8. The MployusPharma (Mployus Personnel Services) Payroll Service is free of Charge for the locum.
  9. MployusPharma (Mployus Personnel Services) basic pay is in accordance with the Protection of Employees (Temporary [2012.] Agency Work) Act 2012.
  10. Basic Pay is the hourly rate agreed and includes: (a) rest periods, (b) rest breaks during the working day, (c) overtime, (d) annual leave @ 8%, or (e) public holidays (where applicable).
  11. Timesheet should be faxed or e-mailed to MployusPharma (Mployus Personnel Services). The cutoff for submission of the timesheets is the last day of the month. Any timesheets received after this date will be processed in the following month.
  12. If the Locum is unable or unwilling for any reason to commence or continue an Assignment, he/she should inform MployusPharma (Mployus Personnel Services) immediately.
  13. If the Locum cancels a booking within 48 hours of the booking, in the case where MployusPharma (Mployus Personnel Services) is required to pay an emergency booking fee to replace the Locum, this fee may be levied against the original Locum at the discretion of MployusPharma (Mployus Personnel Services). MployusPharma (Mployus Personnel Services) Limited will endeavor to reassign the Locum.
  14. If a client cancels a shift within 48 hours and he/she cannot be reassigned, the Locum will be paid a Four-hour fee. MployusPharma (Mployus Personnel Services) reserves the right to charge the Client as if the Locum has completed the 4 hours.
  15. If a locum shift is canceled by a client due to poor performance and/or complaints about the locum's performance, no cancellation fee is payable to the locum.
  16. In the event of a store closing due to adverse weather conditions and the locum is notified prior to traveling to work, no payment will be made to the locum.
  17. If a Client books a locum introduced by MployusPharma (Mployus Personnel Services), direct for any additional work, then the relevant fees/payments will be due by the client to MployusPharma (Mployus Personnel Services).
  18. MployusPharma (Mployus Personnel Services) does not warrant that the service will be uninterrupted or error-free or that defects in the service will be corrected.
  19. MployusPharma (Mployus Personnel Services) will not accept liability of any kind for loss, expense, or damage as a result of the Locum.

These terms of business are subject to the exclusive jurisdiction of the Irish Courts, and all disputes arising out of or in connection therewith shall be determined in accordance with Irish law. In the event of a conflict of interpretation of these terms and conditions with any other company terms, the within terms will be deemed to be the terms and conditions of business of MployusPharma (Mployus Personnel Services).
